Principles relating to processing of personal data

 

We are G. M. PROJECT, s. r. o., a company with registered office at Těšínská 2672/42, 746 01 Opava, Czech Republic, company identification number: 603 18 830, ref. C 11901 registered by the Regional Court in Ostrava.

We run an e-shop on the website https://www.gmproject.cz/

For provision of our services and operation of our website we process certain personal data as a controller of personal data, at the same time, our website uses cookies.

Processing of personal data is regulated in particular by the Act No. 110/2019 Coll., on personal data processing, and the Regulation of the European Parliament and the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/ES (General Data Protection Regulation) (“GDPR“).

 

I. Processing of personal data

 

A. Processing of personal data in the case of use of a contact form

If you demand our products and services, we will handle your personal data you provide to us, in particular using an inquiry form. Particularly, the following (contact) details are concerned: the first name and surname, email. Your phone number can be required on the websites of specific services, it is entered in the case where you want the seller to call you back. 

For what reason?

We will use them to contact you in order to make further arrangements regarding the services demanded.

On what legal grounds?

Processing on the basis of Article 6(1) point (b) of GDPR – contract negotiations or taking steps prior to entering into a contract at your request.

For how long do we process personal data?

Unless we establish further cooperation, we will delete your personal data provided for the purposes mentioned above within 14 days from the date of our last communication.
 

B. Processing of personal data in the case of purchase at the e-shop 

If you register in our e-shop, or you shop in it, we will handle the data which you provide to us for this purpose and especially fill in in an order form. Particularly, the following contact and billing details are concerned: the first name and surname, address, company identification number, phone number and email. 

For what reason?

We have to process personal data in order to perform our contract – to supply our services or goods to you. We will communicate with you using the contact details also regarding the status of your order, and, when applicable, regarding complaints or your inquiries. 

We will further process personal data in order to fulfil our obligations arising from the law (in particular for accounting and tax purposes, or for processing claims etc.).

The requirement to provide personal data is based on the law as well as on a contract, respectively it is a requirement which shall be referred to in a contract (or in an order form). The contract between you and our company cannot be concluded and performed in case of a failure to provide personal data.

On what legal grounds do we process personal data?

Processing on the basis of Article 6(1) point (b) of GDPR – performance of a contract, Article 6(1) point (c) of GDPR – compliance with our legal obligation and Article 6(1) point (f) of GDPR – processing for the purposes of legitimate interests of our company.

For how long do we process personal data?

For the duration of a contract and then 3 years from the date on which such service was supplied or the goods delivered, unless a longer period is required by legal regulations.
 

C. Newsletters (commercial communications)

By filling in your email in the newsletter form and subscribing to the Newsletter you express your interest in sending of our commercial communications, or consent to the processing of your personal data for the purposes of subscription to the Newsletter. The Newsletter may be unsubscribed by you at any time.

On what legal grounds?

Processing on the basis of Article 6(1) point (a) of GDPR – giving consent to the processing of personal data. You have the right to withdraw your consent for the processing of personal data at any time, especially as specified in the following paragraph. If you are an existing customer (and you have not prohibited us from it during your shopping), also the processing on the basis of Article 6(1) point (f) of GDPR can be concerned – processing for the purposes of legitimate interests of our company and we have the right to do it in accordance with Section 7 (3) of the Act No. 480/2004 Coll., on certain information society services.

For how long do we process personal data?

5 years from your subscription to the Newsletter. Any time, you may unsubscribe from newsletter enrolment, in particular by an e-mail (or according to the instructions given in the message with the Newsletter) or contact us using the e-mail address: gmproject@gmproject.cz.

 

II. Who is going to access the data?

 

Your personal data will remain on principle in our company. Personal data provided in order to subscribe to the Newsletter and by means of forms can be processed by the data processor MailerLite Limited, a company registered in Ireland, with registered office at Ground Floor, 71 Lower Baggot Street, Dublin 2, D02 P593, Ireland.

We process personal data on the territory of the European Union only and we do not transfer them to third countries or to an international organization. 

 

III. What you should also know

 

We have no data protection officer appointed in our company.

Decisions are not taken by reason of the automated processing or profiling in our company.

IV. Your rights in relation to the processing of personal data

 

The GDPR gives you, amongst other things, the right to contact us and require information on what personal data we process, to request from us access to these data and have them updated or rectified, or to request restriction of processing, to request from us erasure of personal data in specific situations and, in certain cases, you have the right to data portability. It is possible to object to the processing, among other things, on the basis of a legitimate interest. 

If you think that your data are not handled properly, you have the right to lodge a complaint with a supervisory authority –  The Office for Personal Data Protection, company identification number: 708 37 627, with registered office at Pplk. Sochora 27, 170 00 Prague 7, or bring your claims before the court.

These terms and conditions are effective from 01.01.2022 until further notice.
